1. Acceptance of Terms
By accessing or using the FarmSource marketplace ("Service") operated by FarmSource, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.
These Terms apply to all users of the Service, including customers browsing our marketplace, placing orders, and interacting with our platform in any way.
2. Eligibility & Account Registration
Age Requirement
You must be at least 18 years old to use our Service or place orders.
Geographic Restriction
Our Service is available exclusively to residents of Ohio. By using our Service, you represent that you have a valid Ohio delivery address.
Account Responsibilities
- • You are responsible for maintaining the confidentiality of your account credentials
- • You agree to provide accurate, current, and complete information
- • You are responsible for all activities that occur under your account
3. Marketplace Services
FarmSource operates as a marketplace platform connecting customers with local Ohio farms. We facilitate transactions but are not the producer or seller of the farm products.
Important Notice
While we facilitate transactions, individual farms are responsible for their product quality, descriptions, and fulfillment. FarmSource, LLC serves as the merchant of record for payment processing.
Our Role
- • Provide the online marketplace platform
- • Process payments securely through Stripe
- • Coordinate shipping and logistics
- • Provide customer support for platform issues
- • Collect and remit applicable taxes
4. Ordering & Payment
Order Process
- • All prices are displayed in US dollars
- • Prices include platform fees where applicable
- • Sales tax calculated at checkout
- • Orders are subject to availability
- • We reserve the right to limit quantities
Payment Terms
- • Payment due at time of order
- • We accept major credit/debit cards
- • Payments processed securely via Stripe
- • You authorize us to charge your payment method
- • Refunds per our refund policy
Note: By placing an order, you agree to our cancellation and refund policies as outlined in our Customer Policies.
5. User Responsibilities
As a user of our Service, you agree to:
- Provide accurate delivery information and be available to receive perishable deliveries
- Properly store and handle perishable items according to food safety guidelines
- Report any issues with orders within the specified timeframe (12 hours)
- Use the Service only for lawful purposes and personal use
- Not resell products purchased through our platform without permission
6. Prohibited Activities
You agree not to:
- ✗ Use the Service for any illegal or unauthorized purpose
- ✗ Violate any local, state, or federal laws while using our Service
- ✗ Attempt to bypass our security measures or access unauthorized areas
- ✗ Use automated systems or bots to access our Service
- ✗ Interfere with or disrupt the Service or servers
- ✗ Impersonate any person or entity or falsely state your affiliation
- ✗ Engage in fraudulent activities or provide false information
7. Limitation of Liability
Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Damages
To the fullest extent permitted by law, FarmSource, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
In no event shall our total liability exceed the amount you paid for the specific order giving rise to the claim.
Product Liability
We are not responsible for the quality, safety, or legality of products listed by farms. Farms are independent entities responsible for their products and compliance with applicable laws.
8. Termination
We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe:
- • Violates these Terms of Service
- • Is harmful to other users, farms, or us
- • Could expose us to legal liability
- • Is fraudulent or involves illegal activities
You may terminate your account at any time by contacting customer support. Upon termination, your right to use the Service will immediately cease.
9. SMS Messaging
By opting in to receive SMS messages from FarmSource, you consent to receive text messages related to your orders, account updates, and occasional promotions. You may opt in during account registration, at checkout, or via our marketing sign-up forms.
- Message frequency: Message frequency varies. We send messages infrequently and only when relevant (e.g., order confirmations, shipping updates, occasional promotions).
- Opt-out: You may opt out at any time by replying STOP to any SMS message.
- Help: Reply HELP for assistance, or contact support@farm-source.org.
- Rates: Message and data rates may apply. Check with your wireless carrier for details.
Consent to receive SMS messages is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for how we handle your information.
Additional Terms
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
Entire Agreement
These Terms constitute the entire agreement between you and FarmSource regarding the use of our Service.
